This HAULING CONTRACT is made and entered into this___________ day of _____________ between Pony Express Horse Transportation ("Carrier"), and _____________________________________("Owner"). Owner agreees and authorizes the Carrier to ship Owner's horse(s) as described below subject to the following term and conditions:
Transportation Cost: $___________________________ plus all tolls incurred.

This includes 1/4 hour for pick-up and 1/4 hour for delivery per horse, any additional time will be charged at $50.00 per hour, charged in 1/4 hour increments.
Deposit (50%): $______________________ The deposit and signed contract must be recieved ten business days prior to pick-up unless request is for emergency service, in which case the entire amount of the entire amount (100%) is due and payable at the time of pick-up.
Balance Due: ______________________ The balance due must be paid at the time of pick-up prior to loading any horse. Only cash or cashier's check will be accepted.
Cancellation: Should owner need to cancel, the deposit will be refunded if Carrier is given 48 hours written notice prior to pick-up. Email is preffered: ponyexpress1861@gmail.com Otherwise, the deposit is not refundable. If Owner creates a condition Carrier deems dangerous for transporting, ie.: due to road conditions, lack of access, "difficult loaders", the deposit is not refundable.
Carrier reserves the right to cancel due to weather or any "Act Of God" which creates a condition that Carrier deems dangerous for transporting Owner's horse(s). Should Carrier need to cancel for any reason, Owner will be refunded the deposit in full.

1. The horse(s) shall be in a healthy condition, free from contagious, infectious or transmissible disease unless the horse is being shipped to a veterinarian facility on an emergency basis. In that event, Carrier will only ship the one horse with the health condition. The Owner is responsible for all health certificates required for shipping. These documents may include a current negative Coggins, a veterinarian’s health certificate, and/or a copy of the registration papers both sides, among others.
2. The Owner agrees to provide a halter and rope for each horse, shipping boots are optional.
3. The Carrier shall exercise generally accepted professional standards in the care and supervision of the horse(s).
4. The Owner agrees that the Carrier, or the Carrier’s agents, are not liable for death, sickness, injury and/or accident, including consequential damages caused to the horse(s), unless such was caused by the willful and wanton gross negligence of the Carrier. In such event, the Carrier shall be liable only to the extent of the actual damages and in no event to an amount greater than the fair market value of the horse(s), not to exceed $25,000 total. The Carrier is not liable for death, sickness, injury and/or accident caused by the horse(s) or a third party.
5. The Owner is responsible for all insurance on Owner’s horse(s) and personal property during shipment.
6. The Owner must provide the feed to be given to the horse(s) during shipping. Carrier will provide the horse(s) water as needed during shipping.
7. Carrier will immediately notify the Owner should the horse(s) require veterinarian services during the shipping. In the event the Owner cannot be reached, the Carrier will contact the closest local licensed veterinarian. The Owner agrees to reimburse the Carrier for all veterinary services, medications or other supplies required for the emergency treatment as determined by the Carrier and veterinarian for the health and well-being of the horse(s). Carrier shall have no liability for any such veterinarian services or related costs. The Carrier shall have lien rights against the shipped horse(s) for the value of the
veterinarian services and costs advanced by the Carrier, and shall be entitled to enforce said lien as provided by the laws of the State of California.
8. Carrier is responsible for all rules and regulations governing the shipment of horse(s) including those laws relating to the shipment of horse(s) across state boundaries.
9. Carrier shall have the right to refuse loading and shipping the Owner’s horse(s) should Carrier deem the horse(s) presents a danger to the Carrier or other horse(s) and is therefore a danger to transport. In that event, the Owner will be charged only 50% of the transportation cost.
10. It is agreed and understood that insurance is not provided to the Owner by the Carrier, and Carrier strongly recommends that the Owner carry full liability and/or medical/mortality insurance on any horse(s) being shipped. If the Owner does not carry insurance; the Owner assumes full responsibilities for the loss of the horse(s) should any loss (death or injury) occur.
11. The Owner is responsible for any damaged caused by his or her horse(s). The Carrier shall have the cost of repairing the damage estimated by a licensed facility and will invoice the Owner for payment. Should the Owner dispute the amount, he or she may submit their own written estimate to the Carrier for consideration and/or adjustment.
12. A $50 fee will be charged for any returned checks.
13. This Contract is non-assignable and non-transferable. It is entered into in the State of California and shall be interpreted and enforced under the laws of that state.
14. Should either party breach this Contract, the breaching party as determined by the court, shall be responsible for the other’s party’s court costs and attorney’s fees related to such breach.
15. This Contract represents the entire agreement between the parties. No other agreements or promises, verbal or implied, are included unless specifically stated in this written Contract.

RELEASE OF LIABILITY/INDEMNIFICATION
The Owner releases the Carrier from all liability and fully indemnifies the Carrier, & the Carrier's agents, from any and all liability for any act of neglience or want of ordinary care on the part of the Carrier. The Owner further agrees to indemnify and hold harmless the Carrier, and the Carrier's agents, against all claims, demands and causes of action, including court costs and actual attorneys' fees incurred, arising from any death, injury, or property damage caused by the Owner's horse(s) in connection with the shipping asserted by third parties.
THE UNDERSIGNED IS 18 YEARS OR OLDER AND HAS READ AND UNDERSTANDS THIS ENTIRE CONTRACT AND AGREES TO ITS TERMS.
